1. Acceptance of Terms

By accessing or using JKT Hub (“the App”), operated by JKT Excavation (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

JKT Hub is an internal construction and excavation business management platform. The App provides tools for project estimating, bid management, dispatch coordination, scheduling, equipment tracking, and related operations. It is intended for use by JKT Excavation and its authorized personnel.

3. Account Responsibilities

When you are granted access to JKT Hub, you agree to:

• Provide accurate and complete information during account setup
• Keep your login credentials secure and confidential — do not share your password or account access with unauthorized individuals
• Notify an administrator immediately if you suspect unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

4. Acceptable Use

You agree to use JKT Hub only for its intended business purposes. You may not:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to any part of the App, its servers, or any connected systems
• Interfere with or disrupt the integrity or performance of the App
• Reverse-engineer, decompile, or disassemble any part of the App
• Use the App to store, transmit, or distribute any malicious code or harmful content
• Share, export, or distribute proprietary business data from the App without authorization

5. Intellectual Property

All content, features, and functionality of JKT Hub — including but not limited to software, design, text, and graphics — are owned by JKT Excavation and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for authorized business purposes only.

6. Third-Party Services

JKT Hub integrates with third-party services, including Google Calendar, to provide scheduling functionality. Your use of these integrations is subject to the respective third-party terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party services.

7. Data and Content

You retain ownership of any business data you enter into JKT Hub. By using the App, you grant us the right to store, process, and display that data as necessary to operate the service. You are responsible for ensuring that any data you enter does not violate any third-party rights.

8. Availability and Modifications

We strive to keep JKT Hub available and operational but do not guarantee uninterrupted or error-free access. We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice. We may also update these Terms of Service from time to time, and continued use after changes are posted constitutes acceptance.

9. Limitation of Liability

To the maximum extent permitted by law, JKT Excavation and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of JKT Hub. This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses.

The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Indemnification

You agree to indemnify and hold harmless JKT Excavation from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We reserve the right to suspend or terminate your access to JKT Hub at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violations of these Terms, extended inactivity, or changes in your employment or authorization status with JKT Excavation.

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect, including sections on intellectual property, limitation of liability, indemnification, and governing law.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Michigan.
